Scope of Application

These terms and conditions apply to all orders placed by the customer at www.explorewear.ch from Explore Wear, Fangenstrasse 14 A, 8713 Uerikon. The following general terms and conditions (T&Cs) apply exclusively and in the existing version at the time of order. These T&Cs are an integral part of any contract concluded between Explore Wear and a customer (whether for standard items, custom orders or sale items).  Any ancillary agreements, undertakings or amendments to these T&Cs are only valid in writing. Further the provisions of the Swiss Code of Obligations (OR) is applicable for sales agreements as well as the usual existent laws and regulations in Switzerland.

Conclusion of Contract

Only private customers (at least 18 years) with a valid delivery address may place orders in www.explorewear.ch. Our pricelist, brochures and publications on the internet are effectively without obligation. Any offer can be withdrawn, as long as there is no other written agreement. The contract is accepted upon receipt of the ordered goods. The amount and fulfilment of the delivery is defined in the electronic confirmation of purchase. Customers who are not private customers are requested to contact us by e-mail at info@explorewear.ch

If goods are not available at the supplier, Explore Wear has the right to cancel the order and refund any advance payments money to the customer.

Shipment

When placing an order, the customer has an option to register and set up an individual account or make the order without registration. All personal data will be used solely for the purpose of processing an order. Irrespective of the way in which the order is placed, all data has to be entered correctly and completely. The personal password selected by the customer when registering must be kept strictly confidential. 

If we are out of stock for the specific goods, we will let you know as soon as possible when to expect the delivery. Shipping proceeds at receiver’s risk. Explore Wear is not to be held responsible for any delays and damages during shipment.

If items are undeliverable or delayed due to the customer giving an incorrect delivery address, due to the recipient being absent Explore Wear is not liable.
Explore Wear reserves the right to make partial shipments.
Available products will be dispatched within two working days of receipt of the order if not stated differently. The estimated delivery time is a guideline. Explore Wear is not liable for delays in delivery through no fault of its own, e.g. due to acts of nature, traffic congestion, strikes, poor weather conditions, etc. and the customer is neither entitled to withdraw from their purchase agreement or to compensation. Longer delivery periods for parcels are to be expected before public holidays and for custom orders.

The costs of delivery for the items ordered are charged to the customer. The shipping and handling costs are shown before orders are completed and are indicated separately on the invoice. 
All Shipments are dispatched by Swiss Post.

Prices


All prices are shown in Swiss Francs (CHF), VAT included and shipment charges excluded.

Method of Payment


Shipment will be dispatched after successful payment. 

We will charge the payment amount when we receive the order. The customer can choose to pay for their order by credit card or upon invoice.
The amount quoted on the invoice is payable at the latest by the due date shown on the invoice. Payment is to be made to the account:

No payment slip is enclosed with the invoice. If the invoice is not settled by the due date, the customer falls into arrears upon expiry of the payment term without the need for any further reminder to be issued. 

The items remain the property of Explore Wear until they have been paid for in full.

Right of Return

Orders can be returned within 14 days (date of post stamp) in original packaging and without any traces of usage. The customer is responsible for appropriate packaging of the returned goods and pays the postal fees of the return. Please note that all sales of Sale items (those displaying a reduced price) are final. No exchange, credit note or refund will be offered against Sale purchases and the conditions set out before will not apply.

Returns will be refused if: traces of usage exist and/or products are sent back without the original packaging and labels and/or goods are damaged.

Goods that get lost during shipment cannot be refunded. We highly advise to use a tracking number when returning goods. Resulting postal charges will not be accepted.
Your satisfaction is important to us! Don’t hesitate to contact us if the quality of the ordered product does not fulfil your expectations. Explore Wear check all returned goods carefully on the above mentioned criteria. Upon this, Explore Wear will credit the refund.

Damaged or Wrong

Any complaints in respect of quality and completeness must be lodged with Explore Wear asap, but within 2 days at the latest info@explorewear.ch. Otherwise, the delivery shall be deemed to have been accepted. Deviations in color may be attributable to the monitor used and photographic technology and do not constitute a defect.
Explore Wear shall not be held liable for damage sustained in transit and damage caused by improper storage of the goods once they have been received by the customer or their agents.
Every good is controlled by us before dispatch. Nevertheless, should there exist any defectiveness of the goods - the goods can be returned. Same applies for incorrect delivery, which Explore Wear is responsible for. In this case, return shipping fees are accepted by Explore Wear.

Liabilities

We do not accept any liability for lost or damaged goods according to Swiss regulations. In case other regulations are claimed, Explore Wear only accepts liability up to the transferred amount. If the customer resells the product, he or she is responsible for compliance regarding national and international export provisions. If the customer changes the resold product, he or she is liable for the resulting damages to us, the purchaser or third parties.

Data Security

The data necessary for processing the transaction will be stored and passed on to the company commissioned with delivery for the purpose of performing the contract. Otherwise, stored data will not be passed on to third-party companies, with the exception of credit rating agencies. The database and its contents, maintained by Explore Wear is not handed over to third parties and is only used for internal analysis and newsletter dispatch (revocable at any time).

We hereby expressly make you aware of the risks beyond the control of Explore Wear that are connected with data transfer by e-mail. These risks include the transfer of viruses, damage to and/or loss of data, and unauthorised third-party access. By placing an order, the customer authorises Explore Wear to send documents and other data in unencrypted e-mails.

Redeeming Gift Certificates

Gift certificates can be purchased in our online store. 

Gift certificates may be redeemed for the purchase of Explore Wear products. 
The credit on a gift certificate will not be paid out in cash, nor will interest be accrued. 
Gift certificates and credit amounts may only be used prior to the order process being completed. Gift certificates and credit amounts cannot be subsequently deducted from the purchase price. 
Gift certificates can be used when making orders.
To redeem gift certificates in your customer account or to view your current credit, visit the “My Account” section on www.explorewear.ch.
We accept no liability for the loss or theft of gift certificates or for them being illegible due to circumstances beyond our control. We also accept no liability for spelling mistakes in the e-mail address of the person receiving the certificate. 
Gift certificates are transferable. It is not permitted to use the gift certificates for commercial purposes. Furthermore, it is not permitted to reproduce, edit, or manipulate the certificates. 

Protection of Intellectual Property

Explore Wear owns the design of the website. The contents of the website are protected by copyright. Modification, reproductions or copying of any kind is prohibited.


Final Regulations

Place of jurisdiction is Zürich, Switzerland. Thereby, Swiss law applies exclusively. The parties shall try to settle any dispute resulting from the contract amicably. By ordering goods, the customer agrees to these terms and conditions. Explore Wear reserves the right to modify the terms and conditions at any time.
